Article 1 (Purpose)
The purpose of these Terms and Conditions is to stipulate the rights, obligations and other necessary matters between the Company and the Customer (meaning a person who wishes to further use the Service as a member who has agreed to the Terms and Conditions of Service, hereinafter referred to as the "Customer") in using the Sineps Service (or "the Service", hereinafter referred to as the "Service") provided by Ceres Technologies, Co., Ltd.
Article 2 (Definitions of Terms)
The terms used in these Terms are defined as follows.
'Sineps Service' means a service that provides appropriate answers or various related information through non-human software in response to a natural language-based query request by a customer.
'Sineps Application' means an application created by the Customer using the Service.
'Sineps Model' means a model that models the flow of information extraction and processing in natural language to provide appropriate answers or various related information in response to natural language-based queries.
'Service-related data' means data generated or created by the Customer or User in the course of using the Service.
'User' means a person who uses the Service through the Sineps Application.
Article 3 (Conclusion and Effectiveness of the Service Use Agreement)
① The contract for use of the Service shall be concluded when the Customer agrees to these Terms and Conditions and applies for use and the Company accepts the same.
② Matters not stipulated in these Terms and Conditions shall be governed by relevant laws and regulations, related cases, and service-specific descriptions set forth on the homepage.
Article 4 (Provision of the Service)
① The Company provides an engine that recognizes and synthesizes text and related ancillary functions so that the Customer can provide various services to users using the Service. In addition, Sineps Service customers can link with other services of the Company to store results or conduct further analysis of the stored data. Details such as specific conditions for utilizing this service can be found on the service homepage.
② The personal information of the above third parties that the Company collects and uses for authentication is as follows.
Personal Information and Purpose of Use: Creating an account to use the Sineps Service
Items of personal information collected: email, password, name
Personal information retention and use period: Until the end of the business day
③ In connection with Paragraph 2, the Company shall not be liable for any restrictions on the Customer's use of the Service due to the third party's failure to provide relevant information to the Company.
Article 5 (Compliance and Warranty)
① The Customer shall comply with these Terms and Conditions, relevant laws and regulations, and the terms of use posted on the website when using the Service. The Customer shall indemnify the Company at his/her own expense and effort for any problems arising from the Customer's failure to comply (including any civil or criminal infringement of rights and claims of violation of laws, such as lawsuits from government agencies, rights holders, etc. However, this shall not apply if the occurrence of damages is due to reasons attributable to the Company.
② With the consent of the Customer, the Company may acquire, store, and utilize Service-related data within the scope of the purpose of improving the performance of the Service.
③ In connection with Paragraph 2, the Customer shall comply with the obligations of relevant laws and regulations, such as explaining to the User that the Service-related data generated in the course of the call with the User may be transmitted to the Company and others and utilized for the purpose of improving the performance of the Service, and obtaining the User's consent thereto. If any damage or dispute occurs to the Company, etc. due to the Customer's failure to comply with the matters set forth in the Preamble, the Customer shall compensate the Company, etc. for all damages incurred by the Company, etc. and all expenses incurred to resolve the dispute, and shall further indemnify the Company, etc. from the User at its own risk and expense.
④ The Company may request the Customer to provide necessary information or supporting documents at an objectively reasonable level to verify whether the Customer is complying with this Article, and the Customer shall comply.
⑤ If the Company confirms that the Customer has violated this Article or receives a report of such violation, the Company may take action.
Article 6 (Data Backup)
The Customer may back up the Service-related data stored on the Company's server during the period of use of the Service at any time prior to the termination of the Service Agreement. The Company may delete the Service-related data after the termination of the Service Agreement, and the Company shall not be liable for any damages caused by the Customer's failure to back up the Service-related data in advance.
Article 7 (Integration with Other Services)
The Customer may link the Service with related services of other companies (hereinafter referred to as 'Third Party Services'). However, the Company shall not be liable to the Customer or the User for any failure of the integration due to reasons not attributable to the Company, such as failure of the Third Party Service, change in integration compatibility, change in policy, etc. The Customer shall indemnify the Company at its own risk and expense if the User files a dispute against the Company.
Article 8 (Attribution of Rights)
If the Company has provided any intellectual property rights such as programs, designs, trademarks, etc. to the Customer for the provision of the Service, this is only a grant of limited use rights within the scope of the purpose necessary for the provision of the Service, and in no case does it imply the grant of any rights beyond such limited use rights.
Article 9 (Service Usage Fees)
① The details of the Service usage fees and any changes thereto shall be posted on the Company's Service homepage.
② The fee for using the Service is based on purchasing credits and deducting credits according to the amount of usage.
③ The refund policy is as follows
Request for Refund: Users may request a refund within 30 days after purchasing Credits. Refund requests are made through Customer Support.
Refund of unused credits: Refunds are only available for unused credits. Credits that have already been used are not refundable.
Partial refund: For partially used credits, a refund will be issued only for the remaining unused credits.
Refund Fee: We charge 5% of the total refund amount as a refund processing fee, which will be deducted from the refund amount.
Refund Method: Refunds are processed through the original payment method, which can take 5-10 business days to process.
Exclusions: Credits purchased as part of a promotion or discount are non-refundable, and refunds may not be issued for violations of these Terms.
④ After receiving your refund request, the Company will review your request for eligibility and process it in accordance with the Refund Policy.
⑤ You must provide the required information accurately when requesting a refund, and the Company is not responsible for any delays or problems with refunds due to incorrect information provided.
Article 10 (Service Performance)
① The Company shall not be liable for any failure to use the Service due to reasons attributable to the Customer.
② The Company does not guarantee the reliability and accuracy of the results of the responses (answers) provided by the Customer to the User through this Service, as the results may be affected by the User's usage environment, etc.
Addendum
These Terms shall be applied from June 1, 2024.
